IMPORTANT NOTE: Emails sent that are not in accordance with these instructions will be deleted without a reply.  Calls to chambers at (305) 349 7044 are welcome. Zoom vs. Live Hearings/Trials:  Most court proceedings will take place remotely, via Zoom. Trials and live evidentiary hearings will take place in Courtroom 23B of the Osvaldo Soto Courthouse. When requesting a special set hearing, parties have the option to request a live hearing or a Zoom hearing.

 

Submission of Original Notes: DO NOT FILE OR DELIVER ORIGINAL LOAN DOCUMENTS UNTIL I SPECIFICALLY INSTRUCT YOU TO DO SO. 

 

If Motion for Summary Judgment is granted, you have two options:

 

1.   Deliver to chambers only the original note and mortgage and upload the Final Judgment to Proposed Orders in courtMAP.  All Defendants who are not on the courtMAP service email list must be added to the service list with their street address.

 

2. Deliver the Final Judgment together with the original note/loan documents, copies of FJ, stamped, addressed envelopes, and a check for the Clerk, to chambers. 

Submission of Evidence for Zoom Hearings and Zoom Trials:  The requirements here are only for Zoom evidentiary hearings and trials and are for the benefit of the Clerk. Submissions of courtesy copies to the Court via courtMAP must follow the formatting requirements detailed in the Special Sets section of the webpage.  At least five (5) business days prior to the hearing or trial, each side must:

 

a.         Mark the first page of each document it intends to introduce into evidence. Plaintiff with numbers/Defendant with letters.

 

b.     Submit to the e-Portal, in the manner detailed below, an Exhibit List, containing the exhibit number/letter, with the corresponding brief description of the exhibit, and all exhibits separately.

 

    To Submit Exhibits:   

        a.  Go to the eFiling Portal;

                               b.  Click on "File Pleading in Existing Case;"

                               c.  Enter Case Number;

                               d.  Once the case populates, go to the documents tab, click "Add;"

                               e.  Once Search Bar appears, type "EVIDENCE" and hit "Enter;"

                               f.   Check Off "Evidence Submission," then hit "Browse" which allows you to select the respective document to be uploaded; and

                               g.  Click "Save." 

 

By submitting the documents as indicated above, they go into a separate Evidence Queue that allows the Clerk to access evidence submitted in a particular case. 

 

EACH EXHIBIT MUST BE SUBMITTED SEPARATELY.

Submit the filed Emergency Motion via courtMap to Emergency Motions and simultaneously submit via courtMap toProposed Orders (not as a supporting document to the emergency motion), an order granting the relief sought. The Court will process the order (enter, edit, reject, delete) as it deems appropriate.       

If the submitted proposed order has not been processed, and you have not received communication from the Court within 24 hours, follow up by calling chambers at (305) 349 7044 and speak with Molly or Angelo.

NOTE:  Orders uploaded as supporting documents cannot be entered by the Court. They must be uploaded via courtMAP to Proposed Orders.

Motion Calendar Days/Time/Location:

Motion Calendar hearings are held on Wednesdays and Thursdays, remotely via Zoom. Motion Calendar hearings are limited to five (5) minutes per case. The courtMAP system permits up to two (2) motions per case. Parties on the service list will receive an email from the Court containing the information necessary to connect to the hearing. Zoom link information is no longer available online. It is the responsibility of counsel to provide the Zoom link to anyone not on the service list.

 

To Schedule a Motion Calendar Hearing:

Select an available date and time in courtMAP. The filed motion(s) and all supporting documents must be attached when the hearing is scheduled (see below regarding supplemental submissions and responses). All submissions must comply with the OCR and bookmarking requirements detailed in the Court's procedures governing requests for special set hearings.

 

Once a green "Success" message appears, the hearing has been placed on the calendar. You must still prepare, file, and serve a Notice of Hearing. If the motion(s) are not uploaded to the courtMAP hearing event, the hearing will be cancelled.

 

Supplemental Submissions and Responses:

The Court downloads and reviews materials in advance of hearings. Any courtMAP submission made after the applicable deadline must be brought to the Court's attention.

 

Submit any filed response or supplemental submissions supporting materials in courtMAP’s supporting documents folder for the hearing. The courtMAP submission must comply with the OCR and bookmarking requirements detailed in the Court's procedures governing requests for special set hearings. Please do not overload the supporting documents folder with a large volume of individually uploaded files. Materials must be consolidated into a single bookmarked PDF file.

 

For the Wednesday calendar, submit the materials no later than the end of the business day on the preceding Thursday. For the Thursday calendar, submit the response and any supporting materials no later than the end of the business day on the preceding Friday. If, in rare circumstances, a party submits materials to courtMAP after these deadlines, the party must immediately notify Court staff at 11thCA23@jud11.flcourts.org so the materials can be brought to the Court's attention for review before the hearing. The email subject line must read: SUPPLEMENTAL HEARING MATERIALS.

 

Unilateral Settings:

Parties may unilaterally set hearings on Motion Calendar only if reasonable attempts have been made to coordinate the hearing to no avail.

 

Cancellations:

The party that noticed the hearing may cancel the hearing on courtMAP after filing a Notice of Cancellation. The Notice of Cancellation must specify the reason for the cancellation.

 

Motions for Rehearing, Reconsideration, New Trial, and Other Post-Trial Motions (Entitlement to Fees and Costs):

These motions will not be heard on Motion Calendar. Submit the motion, together with a proposed order, through courtMAP under Proposed Orders.

Proposed Orders

Submit via courtMap to "Proposed Orders" (if the order is on a contested motion) or 

to "Agreed Orders" (if the order is agreed to or unopposed).   

 

Notes:

1) service list for a party that has not provided an email.  

2) DO NOT SUBMIT ORDERS MORE THAN ONCE. It will be reflected as pending until entered or rejected.  If the order is time-sensitive or reflects as pending for more than a week, you may call chambers at (305) 349 7044 and speak with Molly or Angelo to check the status.

3) Title the order accordingly; do not title the order Agreed Order/Proposed Order.

 

4) All proposed orders submitted to "Proposed Orders" or to "Agreed Orders" MUST be in Word format on the courtMap pre-generated blank order form and must be accompanied by the filed motion (i.e., the version of the PDF with the Clerk's stamp) and all supporting documents (i.e. stipulations, returns of service, etc.). Please also submit a letter of explanation if it would be helpful to explain additional context.  

 

5) If a hearing is scheduled, do not submit an order prior to the hearing unless the parties have resolved the motion and are submitting an Agreed Order. 

 

6) An Agreed Order must contain the word “Agreed”.

 

7) The introductory sentence of the proposed order must reference the context in which the motion came before the Court.

 

For example: "This case came before the Court for hearing on XXXX, XX, XXXX on Plaintiff's Motion for . . ."

"This case came before the Court without a hearing on Defendant's Agreed Motion for . . ." 

 

The Court will reject a proposed order that does not contain the specific date on which the motion came before the Court or expressly state that the motion came before the Court without hearing. 

 

 

Proposed Orders Extending Case Management Deadlines

Proposed orders extending case management deadlines must specifically list each pending deadline together with the proposed extended deadlines.  Proposed orders simply extending deadlines by a certain number of days will be rejected.  

 

 

Orders Granting Leave to Amend

If the Court rejects a proposed order granting leave to amend with the message "See webpage re: separate filing," you should separately file the proposed amended pleading on the docket and then resubmit the proposed order referencing the amended pleading by index number deeming it filed.

A. TO SCHEDULE A HEARING

 

1. Select an available date and time via courtMAP after coordinating with, or reasonably attempting to coordinate with, opposing counsel.

 

2. Submit the following to courtMAP, separately, properly identified and titled:

 

a) Completed Special Set Hearing Request Form, available in the Documents section of the webpage;

 

b) In a separate, single PDF file, the motion, together with all exhibits/supporting documents cited in the motion(s), following the formatting requirements below.
Please submit as exhibits/supporting documents all documents the Court will need when reviewing the motion. 

 

For example: when filing a motion to dismiss, please include the operative complaint as a supporting document.

 

3. Formatting requirements.  

The purpose of these formatting requirements is twofold.  First, it is to enable the Court to quickly review referenced exhibits/supporting documents. Second, it enables the Court’s bailiff to easily download, appropriately identify, and electronically organize the parties’ respective filings. 

The courtMAP submissions must be formatted as follows:

 

  1.  BOOKMARK. The PDF submissions must be appropriately and consistently named in a way that identifies the party submitting it and the contents.

     

    To enable the Court to confirm compliance with these requirements and approve a hearing request without first having to download the PDF and open it, add “- BOOKMARKED” to the end of the title.

     

    For example:

    Plaintiff’s Motion for Summary Judgment - BOOKMARKED.pdf

    Defendant's Response to Motion for Summary Judgment – BOOKMARKED.pdf

     

  2. OCR. "OCR" the PDF files. This will make the text within the PDF files searchable. 

     

  3. PDF. For the motion, use PDF software to bookmark the argument headings/sections so the Court can quickly reference them during a hearing.  

     

  4. EXHIBITS. Insert a page before each exhibit with the exhibit number or letter in a large, bold, centered number or letter. The font size should be the largest possible font that will allow the exhibit number/letter to fit on a single page.

     

  5. Use PDF software to bookmark each page containing the exhibit number or letter. The bookmarks must be properly titled and in the appropriate order.  

     

    For example: Ex. A – Affidavit of John Smith

     

  6. LEGAL AUTHORITY. Use PDF software to bookmark any supporting documents, such as legal authority, and title the document properly. Submission of legal authority is optional. Do not submit legal authority unless the authority is material. The file must comply with the OCR, bookmarking, and naming requirements above. The Court does not have access to LexisNexis; therefore, submission of cases available only through LexisNexis is mandatory.

 

Notes: 

 

BINDER DELIVERY. Do not deliver binders or documents to chambers unless specifically instructed to do so. 

 

UNILATERAL SCHEDULING. If opposing counsel has been provided with a reasonable opportunity to coordinate the hearing and is unresponsive, the hearing may be unilaterally scheduled. The attempt and failure to cooperate should be reflected, in detail, on the Special Set Hearing Request Form available in the Documents section of the webpage.

 

TIMING. All available time slots are in 15-minute intervals.  Only 15 minutes are permitted per motion, unless an evidentiary hearing is requested or the hearing is to address many discovery objections. Hearing dates that are beyond the first day of the trial period or projected trial period based on the Case Management Order will not be approved.

 

EMERGENCY/EXPEDITED HEARINGS. DO NOT EMAIL. Call chambers at (305) 349-7044 and speak with Molly if you need an expedited/emergency hearing, a hearing sooner than is available on CourtMAP, or a hearing that will require more than one hour. If it is an emergency, follow the instructions for emergency/expedited hearings.

 

NOTICE OF HEARING. The hearing is not scheduled until you receive an email from CourtMAP that specifically reflects the status as “Approved.” Once approved, the CourtMAP system will generate and file the Notice of Hearing. Do not prepare a Notice of Hearing.

 

AMENDED NOTICE OF HEARING. Please see After Hearing Is Approved below for situations in which you will need to prepare an Amended Notice of Hearing.

 

POST-TRIAL MOTIONS. Motions for Clarification, Reconsideration, Rehearing, New Trial, Remittitur, Additur, and other post-trial motions, excluding motions for fees and costs, must be submitted with a proposed order to Proposed Orders via courtMAP. The Court will review and advise if a response is needed and/or if a hearing should be scheduled.

 

 

B. AFTER HEARING IS APPROVED

  1. Evidentiary hearings.  You must promptly notify the Judicial Assistant, Molly Owers-Hacker, that the Court has approved an evidentiary hearing so she can reserve a Clerk of Court. You must also promptly comply with paragraph 2 below.  

     

  2. Amended Notice of Hearing: The Notice of Hearing is automatically generated and filed by courtMAP and will reflect that the hearing is via Zoom and will not specify whether it is evidentiary, the party that requested the hearing will need to prepare, file, and serve an Amended Notice of Hearing if:

     

    1. The request was for a live hearing or an evidentiary hearing; or  

       

    2. An Add-On was approved by the Court. See paragraph 4 below.

       

  3. Deadline for Submissions. Responses and all additional papers for the Court’s review must be uploaded no later than five (5) business days prior to the hearing in the same manner required when scheduling a hearing. Special set hearings are scheduled on Mondays. All documents must be uploaded by 4:00 p.m. on the Monday of the preceding week.

 

If, in rare circumstances, a party submits any materials to be reviewed for the hearing later than five (5) business days prior to the hearing, the party must immediately notify Court staff at 11thCA23@jud11.flcourts.org to ensure the Court is aware of such materials. So, the materials can be brought to the Court's attention for review before the hearing. The email subject line must read: SUPPLEMENTAL HEARING MATERIALS.

 

 

    4. Add-ons. No add-ons are permitted without prior approval from the Court. Submit a motion with a Proposed or  Agreed Order via courtMAP.  If approved, prepare an Amended Notice of Hearing (see above) and submit all documents under supporting documents in the courtMAP hearing event.


 

C. REQUESTING CANCELLATION

Only the Court can cancel a special set hearing. To request a cancellation:

  1. Prepare a PROPOSED Notice of Cancellation, which must specify the reason for the cancellation.
  2. Upload the Notice of Cancellation under supporting documents in the courtMAP hearing event.
  3. Immediately contact chambers to advise that you have uploaded the Notice of Cancellation to the supporting documents in the courtMAP hearing event.
  4. The Court will review the Notice of Cancellation. IF APPROVED, the party shall file the Notice of Cancellation with the Clerk’s office. Do not file the NOC before it is approved by the Court.
